Acceptable Use Policy

1. Purpose

Photor.ai provides AI-powered image and video generation, editing, enhancement, and related digital services. This Acceptable Use Policy ("AUP") defines permitted and prohibited uses of our platform and forms part of our Terms of Service.

By using Photor.ai, you agree to comply with this AUP, applicable laws, payment processor policies, card network rules, and third-party model provider safety requirements. We may reject prompts, block uploads, remove outputs, limit features, suspend accounts, terminate accounts, or report activity to authorities when required.

2. Permitted Use

Photor.ai is intended for lawful creative, personal, educational, design, marketing, ecommerce, and professional workflows. You are responsible for your prompts, uploaded files, generated outputs, publication decisions, and downstream use of content.

• You must have the rights, licenses, consent, or lawful basis needed to upload and use any content you submit.
• You must review AI outputs before publishing, selling, distributing, or relying on them.
• You must clearly label AI-generated or AI-edited media when disclosure is required by law, platform rules, or context.
• You may not use the Service to bypass safety filters or generate content that is prohibited by this AUP.

3. Prohibited Sexual Content and Nudity

Photor.ai prohibits the creation, upload, distribution, or attempted generation of NSFW, pornographic, sexually explicit, or exploitative content. You may not use the Service to create, edit, request, upload, distribute, or facilitate:

• Pornography, explicit sexual acts, sexual arousal content, fetish content, or erotic nudity.
• Non-consensual intimate imagery, voyeuristic content, revenge pornography, or sexual deepfakes.
• Sexualized content involving minors or anyone who appears to be under 18, including cartoons, anime, stylized images, edits, or implied content.
• Nudity or sexually suggestive content involving private persons without clear consent.
• Prompts or uploads designed to remove clothing, expose intimate body parts, sexualize a person, or transform ordinary images into sexual content.
• Content advertising, facilitating, or promoting sexual services, exploitation, trafficking, or abuse.

4. Child Safety: Zero Tolerance

We have zero tolerance for child sexual abuse material, child exploitation, grooming, sexualization of minors, or attempts to create, edit, simulate, or distribute such material. This includes realistic, fictional, cartoon, anime, AI-generated, or partially generated content.

• Accounts involved in child exploitation content or attempts will be permanently terminated.
• We may preserve relevant evidence and report suspected violations to law enforcement, child protection organizations, payment processors, and other authorities where appropriate or legally required.
• Do not upload images of minors for sexualized, intimate, exploitative, or age-inappropriate edits.

5. Other Prohibited Content and Conduct

You may not use Photor.ai to create, upload, edit, distribute, or facilitate:

• Illegal activity: content or instructions that facilitate crime, fraud, evasion of law enforcement, illegal goods, trafficking, or regulated goods without authorization.
• Hate, harassment, and abuse: hateful, dehumanizing, threatening, bullying, or harassing content targeting protected classes, private individuals, or groups.
• Violence, gore, and bloody content: graphic violence, blood, gore, mutilation, dismemberment, torture, realistic injury, terrorism, violent extremism, threats, instructions for weapons, self-harm encouragement, or content intended to shock or intimidate.
• Impersonation and deception: deceptive deepfakes, false endorsements, fake IDs, forged documents, misleading political content, or synthetic media designed to misrepresent a real person, entity, event, or source.
• Privacy violations: doxxing, surveillance, non-consensual biometric identification, unauthorized face recognition, or exposing private information.
• Copyright and trademark infringement: content that copies or misuses copyrighted works, trademarked names, logos, brand assets, protected characters, trade dress, trade secrets, publicity rights, or other intellectual property without authorization.
• Security abuse: malware, phishing, credential theft, spam, automated scraping, attempts to bypass rate limits, vulnerability exploitation, or attacks on Photor.ai or third parties.
• Payment abuse: stolen payment methods, fraudulent purchases, chargeback abuse, money laundering, sanctions evasion, or activity prohibited by Waffo Pancake, card networks, or financial partners.
• Model abuse: using outputs, prompts, or API behavior to train, fine-tune, benchmark, or build competing AI systems without written permission.

6. Moderation, Monitoring, and Safety Controls

We use automated and manual safety controls to help enforce this AUP. These controls may include prompt filtering, upload scanning, output moderation, abuse detection, rate limits, payment risk checks, account review, and human review of flagged content.

• We may block prompts, uploads, or outputs at our discretion.
• We may review account activity and content when needed for safety, abuse prevention, billing disputes, legal compliance, or support.
• Safety systems are not perfect. You remain responsible for avoiding prohibited content and reporting violations.

7. Enforcement

We may take one or more actions if we believe this AUP has been violated:

• Rejecting, blocking, removing, or disabling access to content.
• Issuing a warning or requiring corrective action.
• Limiting generations, features, credits, or account access.
• Suspending or permanently terminating an account.
• Canceling subscriptions or refusing future purchases where permitted by law.
• Denying refunds for accounts terminated for fraud, abuse, or serious policy violations, except where required by law.
• Reporting suspected illegal or harmful activity to service providers, payment processors, law enforcement, child safety organizations, or regulators.

8. Reporting Violations and Appeals

If you believe content or an account violates this AUP, or if you believe your account was restricted in error, contact us with relevant details, URLs, screenshots, account email, and transaction ID if billing is involved.

We aim to acknowledge urgent safety reports within 2 business days and other reports within 5 business days. Appeals are reviewed based on available account, content, billing, and safety information. Serious safety or legal violations may not be eligible for account restoration.

9. Changes to This AUP

We may update this AUP from time to time to reflect changes in our Service, safety practices, laws, payment processor requirements, or model provider policies. Continued use of Photor.ai after an update means you accept the revised AUP.
